Mayor Letica reported, “That one of my priorities was to put in place sanitation back up driver.  Last week Barry Bradley put in for several PTO days and our new back up driver filled in and did a great job. By having a back up driver vs. calling in a private carting company significantly reduces our costs.  Friday, February 10th Deputy Pam Pierce and I have a meeting set up with Supervisor Petrone to discuss the seawall structure and surrounding area.  Unfortunately this past week my dear mother-in-law (Zellie) and long time friend Gerhard Spielmann passed away.  Zellie was an honorary Asharoken resident who loved being down here with her daughter and grandsons Dan and John.  She felt so attached to the Village that she even made a donation to support Village Hall. Gerhard who I have known for a very long time has served as treasurer for the Village from 1990-1992 and was also the person responsible for erecting the first osprey nest on Duck Island.  The flag in front of Village Hall has been at half staff in his honor.  He came to the United States in 1928-27 with his family from Germany.  He attended Brooklyn Tech he served in the Military in the 82nd Air borne division the 505th parachute regiment.  After his military service, he served a four year apprenticeship as a tool and die maker in a watch case factory where he learned to be a master machinist.  In 1965 he founded Phoenix Machine Products his business manufactured machine components for the Apollo Program Lunar Excursion Module. Many parts he crafted reside on the moon surface today. When the moon program was completed he branched off to military commercial aviation.  Every Boeing 777 and 767 has wing parts that were produced under his direction. His interests turned to miniature machine tools and his first tool model was of the Bridgeport milling machine.  He entered this model into the North American Model Engineering Society completion in April 2003 and he won the best miniature model award.   He earned a private’s pilot license.  He loved Asharoken; fishing, nature, and living in the Village.  I send my condolences to Eleanor Spielmann and the entire Spielmann Family. This is a great loss for the Village.

 

Trustees:

Deputy Mayor Pierce reported that she attended the special meeting on January 23rd. She reviewed the vouchers and minutes.

 

Trustee Ettinger reported that the Village received notice of three grants totaling $32,713.  $19,413 was specifically for the mobile communication equipment. Officer-in-charge Mahdesian will discuss the other two grants.  He thanked Ray Mahdesian for obtaining these grants.  He noted that he attended the special meeting on January 23rd; he attended the monthly court session reviewed the minutes, FOIL’s and payment vouchers.

 

 Trustee Burke reported that she spent time working on the Newsletter which she noted will be distributed tomorrow. She noted that she reviewed the vouchers, minutes and attended the special meeting held on January 23rd.

 

Village Attorney:  Bruce Migatz reported that the Zoning Board met on January 30th for one application on 483 Asharoken Avenue.  The applicant was seeking a side yard setback variance for two existing A/C units and side yard setback variance to add an additional A/C unit and generator.  That variance was granted. They also sought a variance for a front yard and side yard setback to reconstruct a deck that was constructed by a prior owner without a permit and that was also granted.  The Planning Board did not meet in January. On January 31st the applicant Duck Island Corp. made a resubmission of the plans and application addressing the issues raised by the consultants VHB Engineering.  VHB Engineering issued a memo today noting that the applicant still did not address a few points that VHB Engineering had raised previously.  These are minor points but they need to be addressed and hopefully when the plans come back we can then schedule a hearing on the application. The ERB did not meet; they are waiting for GEI Consultants that the Village retained to advise the ERB on the various submissions made by the dock applicants and by parties in opposition to the applications.  Hopefully we may be able to have the meeting next month depending upon when GEI issues their report.

 

Treasurer: Emily Hayes reported that the vouchers for the month of January were $157,580.50.  Included in the vouchers was a payment to the Village of Northport for the fire contract totaling $114,558.60 and a partial payment to Grucci Fireworks for $9,750.00.  There will be a separate resolution to approve the vouchers and budget transfers.

 

Officer-In-Charge:   Officer-In-Charge Ray Mahdesian reported 39 summons and 5 arrests.  He reported that the department received three recent grants which he applied for.  District Attorney Thomas J. Spota awarded $19,413.40 from Asset Forfeiture funds to equip three police cars with new computer systems.  He has also agreed to provide two new traffic radar units to replace two twenty-year old inoperative units which cannot be repaired. The Division of Criminal Justice Services has granted the village $8,800.00 for police protective equipment which will be administered by Suffolk County to local police departments. The Office of Court Administration has awarded the village $4,500.00 to replace the court’s old filing cabinets. He noted when the Nor’easter hit we did not have to close the road.  Mayor Letica pointed out that the Town of Huntington assisted as well with the storm.

 

 Sanitation Operator: Barry Bradley reported that Big Blue is running well.  Total trash tons was 27.36, single stream 7.18 tons for total tonnage for the month being 34.54 tons.

 

Superintendent of Buildings: Doug Adil reported that he reviewed construction drawings for alterations to a home on Asharoken Ave. He provided information in response to an inquiry regarding driveway replacement and storm drainage. He discussed the Village Code requirements for accessory structures with a homeowner. He responded to an inquiry regarding air conditioning to an existing home. He performed 8 inspections in the month of January.

Resolution (2017-11) Be It Resolved that the Village Board authorizes the mayor to sign the polling place contract between the Village of Asharoken and Suffolk County Board of Elections for the Primary Election on September 12, 2017 and the General Election on Tuesday, November 7, 2017and Primary Election for September 2018 and General Election on Tuesday, November 6, 2018, approved as to form.

Resolution (2017-12) Be It Resolved that the Village Board does hereby approve the hourly wage to be $30.00 an hour for a “as needed” Sanitation Equipment Operator (operator of sanitation truck; driver, trash hauler and remover) retroactive to February 1, 2017 for the Village of Asharoken, subject to Board approval.

Resolution (2017-13) Be It Resolved that the Village Board does hereby appoint a committee of the Board of Trustees to include, Mayor Letica, Deputy Mayor Pierce, Trustee Ettinger and Trustee Burke and Assessor Paul Wotzak  as the Board of Assessment Review for the purpose of reviewing any complaints regarding the 2017/2018 assessments filed on or before Grievance Day, February 21st, 2017 and to be reviewed during the hours from 12 noon to 4pm at Village Hall, One Asharoken Avenue, Northport, NY 11768.

NOW, THEREFORE, this Board, pursuant to Article 14 of the Real Property Tax Law of the State of New York, determines to collect the amount of such unpaid taxes levied or assessed for the year 2016/2017 by a tax lien sale in accordance with procedures authorized by the Board of Trustees in the manner and after the form and resolution, certified by the Clerk, shall be transmitted forthwith to the Treasurer of the Village with the account, affidavit, and certificate of such unpaid taxes and is authorized and directed to cause to be published in the official paper of the Village, once each week for three consecutive weeks, a list as shown in the tax roll, with the amount of the tax, penalties, and charges thereon, excepting there from such parcels of property on which the Village holds and owns one or more unredeemed certificates of tax sale; and also a notice  that the said real estate will, on a day subsequent to the expiration of said three weeks to be determined by said Village Clerk and specified in said notice, be sold at a place in said Village to be designated by said Village Clerk, to discharge the tax, penalties, and charges aforesaid, which may be due thereon at the time of such sale, and that the said Village Clerk, at the time and place specified in said notice, proceed with the sale of said real estate upon which such taxes are unpaid, as set forth above, and continue the same from day to day until the sale is completed.  That such real estate shall be sold subject to any unpaid assessments thereon levied by the Village of Asharoken and also subject to any unpaid tax liens purchased and held by the Village.

 

AND BE IT FURTHER RESOLVED, that in all cases where no bid shall be made on a lot or parcel of land so offered for sale for an amount sufficient to pay the said tax, penalties, and charges, the said premises shall be deemed to have been sold to and purchased by the Village of Asharoken, New York

The Village Clerk has advised that the tax sale referred to in the foregoing resolution would be held on Tuesday, March 14, 2017, at 10am to 12 noon, at the Village Hall, 1 Asharoken Avenue, Northport, New York, and that publication of the list of properties to be sold would commence on or about February 16, 2017, and be it further resolved that the Village Board reserves its right to authorize and direct the Village Treasurer on behalf of the Village to reject any and all bids for parcels of lands listed in the annual tax lien sale to be held as set forth herein and, and to bid in and purchase if necessary the same for the Village.

AND BE IT FURTHER RESOLVED, that the Village Board reserves the right to withhold any and all said tax liens from sale and/or to cancel said tax lien sale.

Deputy Mayor Pierce noted that Stephanie Quarles asked to have mentioned that the annual Water Quality Workshop will be held on February 9th at 7pm at the Northport Yacht Club. The workshop is very educational and discusses the progress that has been made.

 

Mayor Letica opened up the meeting for public session.

During public session, two, comments or questions were presented.

1.    Resident indicated that this is a time sensitive issue; it’s regarding Sand Piper Farm and that it is still assessed at the same rate, he asked if the Village has been having any dialogue or anticipating discussions on pilots.  Mayor Letica indicated that Sand Piper has not requested a reduction to date.

2.    A resident asked the Mayor if he could ask Supervisor Petrone what is going on with the National Grid lawsuit with the taxes.
